This Privacy Policy, (hereinafter the "Policy"), details what personal data is collected and how it is processed by Berluti or one of its affiliated entities (hereinafter "Berluti" or "we") when you visit the website www.berluti.com (hereinafter "the Site"), or any other website operated by Berluti (hereinafter collectively "the Sites"), as well as when you visit one of our stores.

Berluti places particular importance on protecting the privacy and confidentiality of the information you provide to us. In this regard, this Policy has been developed in a spirit of transparency, in order to set out the rules and practices we apply with respect to the personal data you communicate to us or share with us through the various touchpoints used in the course of our interactions.

"Personal Data" means any information that allows you to be identified, either directly (such as your name) or indirectly (for example, by means of a unique customer number).

By providing us with your Personal Data, you are informed of the terms under which it is used, analysed and, where applicable, disclosed to third parties, including where such disclosure is subject to your consent, in accordance with applicable regulations and the purposes described herein.

This Policy also describes your rights under the General Data Protection Regulation (hereinafter "GDPR") and any other applicable personal data protection regulations (hereinafter "Applicable Regulations").

We therefore invite you to read this Policy carefully.

Berluti products may be resold in stores or on certain websites operated by independent distributors. This Policy does not apply to such distributors, nor to the websites or mobile applications they operate. To find out how they process their customers' information, we invite you to consult their respective privacy policies.

Berluti, a French public limited company with its registered office located at 120 rue du Faubourg Saint-Honoré, 75008 Paris, France, together with its affiliated entities, depending on the store or Sites you visit, processes your Personal Data as a data controller.

The Personal Data we may collect and process about you includes, but is not limited to:

 

- Identification data: surname, first name;

- Contact data: email address, telephone number, postal address, other contact details;

- Demographic data: gender, date of birth;

- Data relating to your preferences and habits: in particular with regard to clothing and the use of our services;

- Data relating to your personal characteristics: size and style;

- Purchase data: made in store or online;

- Data relating to your browsing and online interactions: in particular on our Sites or our social media pages;

- Connection data relating to the device used: including your IP address, device location, browser type, etc.;

- Content and information you choose to share with us or make public: including through product reviews, posts on our social media pages, or exchanges via our chat tool;

- Service-related data: product repairs and requests submitted to our customer service team;

- Payment data;

- Data relating to your reviews, returns and evaluations of Berluti services;

- CCTV footage.

Depending on the nature of our interactions, your Personal Data may be collected directly from you or indirectly, including when you create and manage your account, subscribe to our newsletter, make purchases, participate in satisfaction surveys or events, submit user-generated content, use our Sites, or in the context of requests submitted to our teams.

Your Personal Data may also be collected through various touchpoints, including your exchanges with our online advisors (chat) or in-store staff, your interactions with our customer service team, the use of forms, or your activity on our social media pages.

In our stores or at events we organise, we may collect additional Personal Data under the conditions and for the purposes specifically notified to you on such occasions.

Finally, we may also collect information you provide to us about other individuals (including their surname, first name, email address and delivery address), for example when you decide to purchase and send products to someone. In such cases, you confirm to us that the people concerned have already been informed that you are sharing Personal Data about them with us, as well as the content of this Policy. We use such information solely to fulfil your requests and will not send commercial communications to your contacts unless they choose to receive communications from us.

We only process your Personal Data where we have a legal basis and a clearly identified purpose for doing so.

Protection of our interests, management of disputes and compliance with our legal obligations
To verify compliance with legal limits on cash payments in accordance with our legal obligations in relation to anti-money laundering and counter-terrorism financing. In the context of your relationship with Berluti, certain information is necessary to process your requests, manage your purchases or provide you with the products and services offered. This mandatory data is marked with an asterisk on our forms, both online and in-store.

The provision of this information may be required for the performance of a contract, to condition its conclusion or to meet legal obligations to which Berluti is subject. Failure to provide this data may result in us not being able to comply with your request or provide you with the relevant products and services.

The other information on the various forms is optional and only allows us to get to know you better in order to meet your expectations more accurately, and to be able to send you, if you agree, information about new Berluti collections, private sales, events, etc.

Personal Data is retained for a period not exceeding that necessary to achieve the purposes for which it was collected. It is not kept in a form that allows you to be identified beyond what is reasonably necessary for those purposes, and in any event not beyond the applicable statutory limitation periods. Your Personal Data will be retained for:

• 3 years from your last interaction with us if you are a prospect, meaning you have not made any purchase but are interested in Berluti; or

• 10 years from your last purchase or last service performed, if you are a customer.

 

In certain specific cases, your Personal Data will be retained for a shorter period of time. For example, footage collected in stores by CCTV systems is retained for one month. In addition, information relating to payment information will be stored securely for the period necessary to confirm your order and process payment, and will then be immediately deleted. In the event of a payment default, your Personal Data will be retained for the entire duration of the management of the incident.

Your Personal Data will remain confidential and will not be disclosed or made available to third parties, except in the cases referred to in this Policy.

Your Personal Data is therefore accessible only to members of Berluti staff and/or its affiliated entities who have a need to know it in the course of their duties within Berluti. Access controls are in place to limit and manage such access.

 

Your Personal Data may also be transferred and/or made accessible to third parties, including:

- Our service providers or business partners engaged to fulfil the purposes described in this Policy, and in particular:

o Third parties who assist us with Customer Service, o Payment service providers and credit analysts,

o Fraud detection and prevention service providers,

o Cross-border e-commerce service providers. In this regard, please note that if your delivery address is located outside France, Belgium, Spain, Italy, Monaco, Germany, Switzerland, the United States or Japan, the company Global-e will handle the sale of Berluti products on our Sites and will therefore process your data as a data controller in accordance with its personal data protection policy accessible here and on the Global-e payment page.

o Technical service providers and technology service providers (e.g. hosting and maintenance of the IT solutions used by Berluti), o Logistics, transport and delivery service providers,

o Advertising, marketing, digital communications and social media agencies,

o Service providers who assist us in the organisation of our events.

- Within the LVMH Group, subject to your consent and under the conditions described in Section 9 of this Policy;

- Any actual or potential acquirer, assignee or successor, actual or potential, in the context of a restructuring, acquisition or merger involving our company, including during the negotiation phase,

- Any authority, jurisdiction or other third party where required by law, regulation or court order, or where necessary to protect or defend our rights.

Your Personal Data is processed by Berluti in France. However, Berluti has affiliated entities and may engage service providers located outside the European Economic Area (hereinafter "EEA").

Any transfer of your Personal Data outside the EEA is carried out subject to the implementation of the appropriate safeguards, in particular contractual safeguards, or compliance with other requirements set out in the Applicable Regulations.

9.1. What is the context of the processing?

Berluti is part of the LVMH Group, which comprises numerous exceptional Maisons offering high-quality products and services across all sectors: Fashion & Leather Goods, Perfumes & Cosmetics, Watches & Jewellery, Wines & Spirits, Selective Retailing, and Other Activities. 9.2. What is the purpose of the processing?

If you are a customer of our Maison, you may also be a customer of other LVMH Group Maisons.

Accordingly, obtaining information related to your product category preferences and purchasing behaviour from other LVMH Group Maisons may help us improve our existing marketing and profiling activities.

Our aim is to continuously enhance your customer experience by offering you personalised offers and services as well as personalised communications that are more in line with your expectations. This is based on a better knowledge of your preferences and interests.

The processing of your Personal Data for the purpose described above does not involve profiling or automated decision-making that may result in legal consequences or a significant impact on you. In addition, we do not use sensitive Personal Data in this context.

 

9.3. How does the processing work?

To achieve this objective, data relating to your product preferences, purchasing behaviour and purchases made during the past 3 years will, subject to your express prior consent, be transmitted to the Group LVMH, our parent company acting as a data processor, in a pseudonymised form (meaning that neither your name nor your contact details will be transmitted).

All data relating to your product preferences, purchasing behaviour and purchases made within our Maison and within other LVMH Group Maisons, to which you have also given your consent (the "Authorised Maisons"), will be reconciled. Based on this analysis, Berluti and the other Authorised Maisons, each acting as independent data controllers, will receive additional information from LVMH Group about your purchasing habits and preferences (without, however, knowing in which other Maison(s) you have made those purchases).

No data will be shared with other LVMH Group Maisons to which you are neither a prospect nor a customer and/or to which you have not given your consent.

Furthermore, to carry out the data reconciliation, we use, as a data controller, artificial intelligence algorithms provided and operated by LVMH Group, acting as a data processor.

These algorithms are regularly trained to maintain their accuracy and to prevent bias. This training activity is carried out using pseudonymised data relating to product preferences, purchasing behaviour and purchases of all our customers and prospects. This processing activity is based on our legitimate interest.

This data is also used to produce statistical reports aimed at assessing the relevance of our marketing and profiling activities, based on our legitimate interest.

These reports are provided in the form of aggregated data.

 

9.4. Note regarding your rights in relation to this processing

You may withdraw your consent to the cross-referencing and sharing of your data at any time.

We draw your attention to the fact that the withdrawal of your consent to this processing will apply only to the consent given to Berluti. Accordingly, consent given to another Maison separately will not be affected, unless you exercise your right directly with that Maison.

You may also object at any time to AI training and data analyses.

In accordance with the Applicable Regulations, you have the rights set out below.

 

Right to withdraw consent

You have the right to withdraw your consent at any time and without justification where the processing of your Personal Data is based on your consent, without affecting the lawfulness of the processing carried out prior to its withdrawal.

 

Right of access

You have the right to obtain confirmation that we are processing your Personal Data and, where applicable, to access or receive a copy of it, as well as to obtain any relevant information about how it is processed.

 

Right of rectification

You have the right to ask us to rectify or complete any Personal Data concerning you that is inaccurate or incomplete.

 

Right to erasure

You have the right to obtain the erasure of your Personal Data under certain conditions.

This right can only be exercised in specific cases: (a) if you withdraw your consent to processing based on that legal basis; (b) if you object to the processing; (c) if your data has been processed unlawfully; (d) if your data is no longer necessary for the purposes for which it was collected; (e) if your data must be erased in order to comply with a legal obligation to which we are subject. However, we are not required to comply with such a request, in particular where the processing is necessary for compliance with a legal obligation to which we are subject, or for the establishment, exercise or defence of legal claims.

 

Right to restriction of processing

You have the right to request that we restrict the processing of your data, meaning that we keep retaining it but we do not use it, under certain conditions.

In practice, if you contest the accuracy of the data we are using, or if you object to your data being processed, the law allows us to carry out a verification or examination of your request. During this period, you may ask us to freeze the use of your data. Conversely, you may directly request the restriction of processing of certain data where we intend to erase it. This will enable you to retain the data, for example in order to exercise a right. We may, however, continue to use your Personal Data where you have given us your consent, or where it is necessary for the establishment, exercise or defence of our legal rights, or for the protection of the rights of another person.

 

Right to data portability

You have the right to require, under certain conditions, that we transmit your Personal Data to you in a structured, commonly used and machine-readable format, or that we transmit it to another data controller of your choice.

This right can only be exercised where the processing of your Personal Data is based on your consent or on a contract, and is carried out by automated means.

 

Right to post-mortem directives (applicable in France)

You have the right to establish general or specific directives as to how you want us to retain, delete and/or disclose your Personal Data after your death.

A person of your choice may be designated to carry out these directives. In the absence of such directives, your heirs will nonetheless be able to exercise certain rights. This right is applicable in France and in any other EU country where mandatory local provisions provide for it.

 

Right to object

You also have the right to object to the processing of your Personal Data on grounds relating to your particular personal situation, where such processing is based on our legitimate interest. If you object, we must cease such processing, unless we can demonstrate that there are compelling legitimate grounds for continuing to process your data that override your interests, rights and freedoms, or that it is necessary for the establishment, exercise or defence of legal claims.
