BERLUTI deelt de gebruiker mede dat BERLUTI producten uitsluitend worden verkocht in winkels met het BERLUTI merk en bij erkende distributeurs wereldwijd evenals via de e-commerce afdeling van de website, die slechts toegankelijk is in bepaalde landen, waarvan de lijst op de website te zien is.

Aankopen gedaan op andere verkooppunten zijn geheel voor risico van de koper, met name wat betreft de echtheid van dergelijke producten.

Op de toegang tot de website en het gebruik van de inhoud ervan zijn onderstaande gebruiksvoorwaarden van toepassing (de “gebruiksvoorwaarden”). Het bezoeken van en browsen op de website houdt in dat de gebruiker alle onderstaande bepalingen onvoorwaardelijk accepteert.

De websitegebruiker wordt medegedeeld dat BERLUTI de gebruiksvoorwaarden van de website kan wijzigen.  Veranderingen of wijzigingen worden onmiddellijk van kracht vanaf het moment dat zij op de website worden gepubliceerd.  Door de website te gebruiken op of na de datum van inwerkingtreding van eventuele wijzigingen en/of updates gaat de gebruiker met deze wijzigingen akkoord.

De website en alle inhoud en andere onderdelen daarvan, met name het BERLUTI logo, de domeinnamen, alle ontwerpen, teksten, illustraties, afbeeldingen, informatie, gegevens, software, audiomateriaal en andere bestanden, evenals de selectie en indeling daarvan (gezamenlijk de “site-inhoud”) zijn het exclusieve eigendom van BERLUTI, en alleen BERLUTI heeft het recht de aan deze website verbonden intellectuele eigendomsrechten en persoonlijkheidsrechten te gebruiken en benutten, inclusief de handelsmerken, tekeningen en modellen, auteursrechten en rechten op afbeeldingen, onder oorspronkelijke eigendomstitel of op grond van uitdrukkelijke toestemming, octrooien of ander recht van intellectuele eigendom.

De websitegebruiker heeft een beperkt niet-overdraagbaar recht van toegang tot en gebruik van de website en de site-inhoud uitsluitend voor persoonlijke en informatieve doeleinden. Dit recht van toegang is onderworpen aan de gebruiksvoorwaarden en omvat niet: (a) doorverkoop of commercieel gebruik van de website of de site-inhoud; (b) het verzamelen en gebruiken van lijsten, afbeeldingen of beschrijvingen van producten; (c) hele of gedeeltelijke verspreiding, uitvoering of openbare presentatie van de site-inhoud; (d) hele of gedeeltelijke wijziging of afgeleid gebruik van de website of de site-inhoud; (e) het gebruik van gegevensextractie, software/algoritmen of andere gelijksoortige methoden van gegevensverzameling of -extractie; (f) het downloaden (anders dan caching) van enig deel van de website of de site-inhoud of van enige daarin vervatte informatie, met uitzondering van wat uitdrukkelijk is toegestaan op de website; of (g) het gebruik van de website of van de site-inhoud voor andere doeleinden dan waarvoor deze bedoeld zijn.

Zonder de toestemming van BERLUTI is ieder gebruik van de website of van de site-inhoud, anders dan het in deze gebruiksvoorwaarden specifiek toegestane gebruik en anders dan voor persoonlijk, privé of niet-commercieel gebruik, ten strengste verboden en dit zal automatisch en zonder kennisgeving vooraf een eind maken aan het toegangsrecht van de gebruiker.  Een dergelijk ongeoorloofd gebruik kan bovendien een schending van de wet vormen, met inbegrip van auteursrechten en rechten op handelsmerken. Tenzij uitdrukkelijk bepaald, kan geen enkele bepaling van deze gebruiksvoorwaarden worden geïnterpreteerd als toekenning op enigerlei wijze, ook niet impliciet, van een titel of eigendom of van exclusieve gebruiksrechten op intellectuele eigendom of andere aanverwante rechten.

BERLUTI kan geheel naar eigen inzicht en zonder kennisgeving vooraf het toegangsrecht van de gebruiker tot de website beëindigen om een bepaalde reden en met name (i) op verzoek van een wetshandhavingsinstantie of andere overheidsinstantie, (ii) op verzoek van de gebruiker (verwijdering op verzoek van de “Mijn Berluti ruimte” account), (iii) in het geval van een onderbreking of belangrijke verandering van de website of van een op of via de website geboden dienst, of (iv) in geval van een onderhouds- of veiligheidsprobleem of enige andere technische moeilijkheid.

In het geval van door BERLUTI tegen de gebruiker ingestelde rechtsvervolging op grond van inbreuk op deze gebruiksvoorwaarden zijn alle opgelopen kosten, rechten, advocatenkosten, vergoedingen etc. uitsluitend voor rekening van de gebruiker, die hiertoe de verplichting op zich neemt.

BERLUTI besteedt de uiterste zorg aan de nauwkeurigheid en het bijwerken van de op de website gepubliceerde informatie en behoudt zich het recht voor de inhoud ervan op ieder moment en zonder kennisgeving vooraf te wijzigen.

Onder de voorwaarden en binnen de grenzen bepaald bij de wet is Berluti niet aansprakelijk voor:
-   enige vaagheid, onjuistheid of weglating ten gevolge van inmenging van een derde, die leidt tot een wijziging van de op de website beschikbare informatie;
-   schade veroorzaakt door ongeoorloofde toegang van een derde tot de website of die toegang tot de website onmogelijk maakt.

De informatie in de door BERLUTI uitgegeven persberichten wordt uitsluitend geacht juist of actueel te zijn op de datum van publicatie daarvan. BERLUTI is niet voornemens om de in genoemde persberichten vervatte informatie te actualiseren en ontslaat zichzelf met name van elke verplichting om dit te doen. 

BERLUTI kan verwijzen naar links naar websites of diensten van derden. Toegang tot genoemde websites en informatie wordt uitsluitend verschaft voor informatieve doeleinden als een dienst aan de gebruiker. BERLUTI oefent geen controle uit op de inhoud van verklaringen op websites van derden. Dientengevolge geeft BERLUTI geen garantie voor de nauwkeurigheid of uitputtende aard van de inhoud, informatie of meningen die op websites van derden worden gegeven of van andere informatie van derden die op genoemde websites wordt gepubliceerd. Gebruikers bekijken en gebruiken de op genoemde websites gepresenteerde informatie voor eigen risico. BERLUTI wijst alle aansprakelijkheid van de hand aangaande de inhoud van genoemde websites van derden waarnaar een link op de website staat.

Hyperlinks naar de website mogen alleen worden gecreëerd met de voorafgaande schriftelijke toestemming van BERLUTI, die op elk moment herroepen kan worden.

Voor zover wettelijk toegestaan sluit BERLUTI iedere aansprakelijkheid uit voor schade of nadeel, van welke aard ook, die het gevolg is van of verband houdt met het gebruik van de website.

De websitegebruiker verplicht zich BERLUTI, zijn bestuurders, directeuren, aandeelhouders, voorgangers, opvolgers, werknemers, agenten, filialen en gelieerde bedrijven schadeloos te stellen en van alle aansprakelijkheid te ontslaan voor enige eis, verlies, financiële verantwoordelijkheid, klachten of kosten (inclusief proceskosten) ten gevolge van door derden tegen BERLUTI ingestelde rechtsvorderingen, die te wijten zijn aan of verband houden met het gebruik van de website door de gebruiker.

Persoonsgegevens verzameld in het kader van het gebruik van de website worden verwerkt in overeenstemming met BERLUTI’s Privacy policy.

Op deze gebruiksvoorwaarden is het Franse recht van toepassing. De Franse rechterlijke instanties zijn territoriaal bevoegd om kennis te nemen van geschillen met betrekking tot het gebruik van de website, ongeacht het land waar de gebruiker woont.

Indien enige bepaling van deze gebruiksvoorwaarden strijdig met de wet, nietig of om enige reden niet toepasbaar wordt verklaard, zal deze bepaling buiten beschouwing gelaten worden zonder de geldigheid of toepasbaarheid van de andere bepalingen te beïnvloeden.

BERLUTI informs the user that BERLUTI products are sold exclusively through BERLUTI brand stores and approved distributors worldwide and on the e-commerce section of the Website, which is only accessible from certain countries which are listed on the Website.

Any purchase outside these sales outlets will be at the purchaser’s own risks, especially concerning the authenticity of the said products.

The access to the Website and the use of its content is subject to the terms of use described below (the “Terms of Use”). The user’s access to and browsing on the Website constitutes an unreserved acceptance by the user of all the provisions below.

The Website’s users are informed that BERLUTI may have to modify the Terms of Use of the Website. Any change or modification will come into force as soon as the modifications are published on the Website. The use of the Website during or after the effective date of the modifications and/or updates automatically entails the user’s acceptance of the said changes.

The Website and the whole of its content and other components notably including the BERLUTI logo, the domain names and all the designs, texts, illustrations, images, information, data, software, sound material, other files as well as their selection and arrangement (together the “Website’s content”) are the exclusive property of the BERLUTI company which is exclusively authorized to use and exploit the intellectual property rights and the personality rights attached to this Website, and in particular trademarks, drawings and designs, copyright and rights to the image either as original rights or by an express authorization, patent or any intellectual property right.

The Website’s user has a limited and non-transferable right to access and use the Website and to the Website’s content exclusively for personal and informative purposes. BERLUTI can terminate the user’s right of access to the Website at its sole discretion and without notice for a specific reason and in particular (i) on the request for a statutory body or any other public organization, (ii) on the request of the user (deletion of the My Berluti Space account on request), (iii) in the event of the suspension or significant modification to the Website or a service offered on or via the Website, or (iv) for a problem of maintenance, security or any other technical constraint.

If BERLUTI brought legal proceedings against the user following a breach of these Terms of Use, all the costs, fees, dues, lawyers’ fees, indemnities etc. incurred would be paid exclusively by the user who agrees to this.

BERLUTI endeavours to do its utmost to guarantee the accuracy of and to keep the information published on the Website up-to-date, and it reserves the right to correct the content at any time without notice.

Under the terms stipulated by law, BERLUTI does not incur any liability for:

• Any inaccuracy, error, omission, or for any damage resulting from an intrusion by a third party which results in a modification to the information available on the Website;
• Any damage caused by an unauthorized third party accessing the Website or making it impossible to access the Website.

The information contained in the communiqués issued by BERLUTI can only be deemed to be exact or current on the date of their publication. BERLUTI has no intention to update and specifically disclaims any liability for any duty to update information contained in the said communiqués.
